Terms and Conditions of Use

These Terms and Conditions of Use (the “Terms of Use”) apply to e-learning plus. (“e-learning plus”) website (the “Site”) located at www.e-learningplus.com and e-learning plus academy located at www.englishlearningplus.com

In accordance with Spanish Law, article 10 of Law 34/2002, on Services of the Information Society and Electronic Commerce, we hereby inform you of the following Terms of Use which it is advised you read carefully before using the Site.

Using the Site will be considered that you accept these Terms of Use and agree to adhere to our policy. IF YOU DO NOT AGREE TO THIS TERMS OF USE, DO NOT USE THE SITE.

e-learning plus reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time. It is your responsibility to check these Terms of Use periodically for changes. Your continued use of the Site following the posting of changes will mean that you accept and agree to the changes.

Use of the Site

e-learning plus grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Site in accordance with this Terms of Use.

All program software, text, artwork, graphs, charts, reports, computer code, etc. (collectively, the “Content”) including but not limited to the design, structure, selection, coordination, expression, “look and feel” and arrangement of such Content, contained on the Site is destined to your personal, non-commercial use. The use of press releases and other documents classified as public is permitted in public communications if the source for the information has been stated.

You also agree that any violation by you of these Terms of Use will constitute an unlawful and unfair business practice and will cause irreparable harm to e-learning plus, for which monetary damages would be inadequate, and you consent to e-learning plus obtaining any injunctive or equitable relief that e-learning plus deems necessary or appropriate in such circumstances. e-learning plus, elp and english learning plus are the trademarks or registered trademarks of e-learning plus in Spain and/or other countries. e-learning plus products referenced herein are either registered trademarks or trademarks of e-learning plus.

By accessing the Site, you agree that you have read, understand and agree to the e-learning plus Privacy Policy, which is a part of this Agreement. e-learning plus may change the Privacy Policy at any time without notice.

Use of Communication Services

The Communication Services may contain e-mail services, forums, communities, and/or other message or communication facilities designed to enable you to communicate with others. You agree to use the Communication Services only to post, send and receive messages and material that are proper and, when applicable, related to the particular Communication Service. e-learning plus has no obligation to monitor the Communication Services. However, e-learning plus reserves the right to review materials posted to the Communication Services and to remove any materials in its sole discretion. e-learning plus reserves the right to terminate your access to any or all of the Communication Services at any time, without notice, for any reason whatsoever.

Modification

e-learning plus reserves the right to do any of the following, at any time, without notice:

to modify, suspend or terminate operation of or access to the Site, or any portion of the Site, for any reason.
to modify or change the Site, or any portion of the Site, and any applicable policies or terms.
to modify, change or delete any Content, or any portion of the Content appearing on the Site.
to interrupt the operation of the Site, or any portion of the Site, as necessary to perform routine or non-routine maintenance, error correction, or other changes.

Unsolicited idea submission policy

e-learning plus or any of its employees do not accept or consider unsolicited ideas, including ideas for new advertising campaigns, new promotions, new products or technologies, processes, materials, marketing plans or new product names. Please do not send any original creative artwork, samples, demos or other works. The sole purpose of this policy is to avoid potential misunderstandings or disputes when e-learning plus products or marketing strategies might seem similar to ideas submitted to e-learning plus. So, please do not send your unsolicited ideas to e-learning plus or anyone at e-learning plus. If, despite our request not to send us your ideas and materials, you still send them, please understand that e-learning plus makes no assurances that your ideas and materials will be treated as confidential or proprietary.

Unlawful or Prohibited Use

You must not use this Site with unlawful purpose. Governing Law; Dispute Resolution

You agree that all matters relating to your access to or use of the Site, including all disputes, shall be governed by and construed and enforced in accordance with Spanish law without reference to conflicts of law rules and principles. The user agrees that any dispute or litigation under these Terms of Use arising between the User and e-learning plus will be resolved by the courts and tribunals of Malaga, Spain.

Severability

In the event that any provision contained in these Terms and Conditions will be declared invalid, it shall be withdrawn or replaced. Such declaration of invalidity shall not affect the validity of the remaining provisions contained in this Legal Notice.
